Hi. My name’s Janelle. Want to hear about my life?
Yes or no?
Okay, good! I am an artist and cartoonist. I pretend some of my toys are pets whenever Eli and Anya are not around to play with me. I name them usual names. But my toys are pets, and I play with them a lot. I play with my stuffed animal dogs and my stuffed animal cat Zazzles. I’m also homeschooled because my mom wanted me to do it because she was homeschooled too.
I first started liking Garfield and then Calvin and Hobbes and then Foxtrot and also the Far Side. I laugh about the shark comics on the Far Side because they are so funny. I also sometimes do my own comics.
Fair Use of Copyrighted Characters Trademarks of other Artists (written by my Dad)
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
-
- the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; [Dad: All uses of copyrighted material are for educational and nonprofit purposes. This site does not contain any advertising.]
- the nature of the copyrighted work; [Dad: The nature of the copyrighted works are such that they entice children to imitate them. Even Janelle’s comics that are not entirely original still bear her own interpretation and sense of humor. They are the visual equivalent of fan fiction.]
- the amount and substantiality of the portion used in relation to the copyrighted work as a whole; [Dad: Although her output is prolific, Janelle isn’t just taking several pages of a published comic book and tracing them. Even if she imitates a three panel comic, she will often change the story slightly and add her own interpretation.]
- the effect of the use upon the potential market for or value of the copyrighted work. [Dad: Janelle’s work is not going to have any negative impact on the potential market or value of the copyrighted works. If anything, the readers and viewers of this blog might pick up a comic that they haven’t looked at yet.]
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
